Waiver

Failure of strict performance of any condition under any agreement herein, or the failure of either Party to exercise any of its rights or remedy hereunder, shall not constitute a waiver thereof and shall not cause a waiver of the obligations under any agreement, unless expressly stated, agreed upon and signed by both Parties.
